PLEASE READ CAREFULLY. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS.

This Release and Indemnity Agreement (the “Release”) is between the individual indicated below (“me,” “my,” or “I”) and the Maine Audubon Society (including the following Chapters: Downeast Audubon, Fundy Audubon Merrymeeting Audubon, Penobscot Valley Audubon, Western Maine Audubon, and York County Audubon) and the Mid-Coast Audubon Society (collectively “Audubon”). In order to participate in volunteer and/or other activities related to or sponsored by Audubon and use Audubon facilities and equipment (collectively the "Activities"), on my own behalf and on behalf of my insurers, guardians, personal representatives, heirs,
beneficiaries, successors, and assigns, I agree to the following terms.

Acknowledgement of Volunteer Status

I acknowledge and agree that I am not an employee of Audubon and that I will not receive any compensation or benefits for my participation in the Activities nor be eligible for any coverage under Maine Workers’ Compensation laws. If I am injured or become ill during the Activities, I hereby permit Audubon to administer first aid and seek medical assistance on my behalf. However, I acknowledge and agree that I am solely responsible for medical bills as well as for having insurance coverage for my injuries and illnesses.

Assumption of Risk, Release, and Indemnification

I acknowledge that participation in the Activities comes with inherent risks including, but not limited to, property damage, personal injury or death, and illness including, without limitation, COVID-19. I voluntarily accept and assume full responsibility for these risks.

I release, hold harmless, and indemnify Audubon and its successors and assigns, and their insurers, directors, officers, trustees, employees, volunteers, trip leaders, co-sponsors, chapters, contractors, and agents (the “Audubon Parties”) from and against any and all claims, demands, liabilities, and losses of whatever kind or nature arising out of or from my participation in the Activities, including without limitation claims arising out of the negligence or fault of the Audubon Parties.

By participating in the Activities, I consent to be photographed, filmed, and/or otherwise recorded and agree that all such photographs and recordings, and any reproductions, are the sole property of Audubon and may be used by Audubon for any purpose without compensation or prior approval.

This Release is intended to be as broad and inclusive as permitted, and is governed by Maine law, exclusive of its conflicts of law rules. If any portion of this Release is found to be unenforceable, the remaining portions shall remain in full force and effect. I have had an opportunity to read and consider this Release, and I sign it voluntarily.
